This agreement is between the client booking the photography session (hereinafter referred to as the "Client"), and  Kirsty Smith Photography,  herein after referred to as the "Photographer"

Cancellation: 
You have 14 days to cancel this agreement in writing however in the event of the Client cancelling the session for whatever reason the booking fee of £10 is non-refundable. It will be considered as liquidated damages to the Photographer.

Payment

A non-refundable deposit of £10 will be taken at the time of booking to secure your shoot, the remaining amount can either be payed at the time of booking or on the day via cash or card.
Entire Agreement: This agreement contains the entire understanding between the Client and the Photographer.

Cooperation: The Client and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. 

Copyright Law: The copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions. The images taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, publication or any commercial use of the photographs is not allowed without prior written permission from the Photographer. Alternation of any images handed to the client is strictly forbidden by anyone other than the original photographer, you may not pass copies of any images to any other professionals  without the prior consent of your photographer.

RAW images will remain the property of the photographer and cannot be transferred to the client or purchased.

Model Release: The Client grants the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the Client for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Client hereby release the Photographer and its legal representatives, heirs and assigns from all liability and claims in connection with the images. 

Editing
Your photographer has full rights to make the selection of the images that she feels are the images that reflect her style and quality of work, during the image selection process any images that are not suitable for selection are removed and not available to the client, your photographer is allowed to have full artistic licence with editing.
Fifteen edits are normally provided for your gallery, this is not a minimum and if this can not be achieved this is out of the control of the photographer.

For an Inside The Box shoot you will be provided with the final composition image.

Alternation of any images handed to the client is strictly forbidden by anyone other than the original photographer, If any re-edits are required after images are handed over 2 images can be re-edited free of charge. After this the photographer will charge for each additional image to be re-edited.

Editing time after the session can be up to 3 or 4 weeks.

Retouching
It is not possible for your photographer to know how you prefer to look, and can not spend the time in your shoot adjusting your hair or clothing to ensure it is perfect to you as every person prefers something different.  Please ensure you look the way you would like to in the photos before they are taken.

Limit of Liability: If a photographer is too ill or becomes injured and cannot attend your session another alternative date can be arranged, and the photographer cannot be held liable for any loss of earnings incurred for missed sessions and will reschedule to a session that suits the client.

The photographer will not be held accountable for any accidents that take place in or around the studio. Any damages must be paid for.

Cancellation: 
In the event of the Client cancelling the session for whatever reason, the booking fee of £10 is non-refundable. It will be considered as liquidated damages to the Photographers.  If the session is cancelled with less than 24 hours notice the full basic session fee is retained to cover the loss of bookings for that date.

 

Sale Items
Kirsty Smith Photography reserves the right to reduce the cost of sessions or digital files at times throughout the year as an "offer" or "sale" if you have paid full price for a session or digital files at another date it is not possible to then receive the discounted price for  items previously purchased at an earlier date.

Images Online

It is not permitted to screenshot, or attempt to remove a watermark of any images which have not been purchased.

The photographer will keep a copy of your images on their computer for 6 months after your shoot then they will be destroyed.

Once you have received your online album you will have one calendar month to pick which images you would like and notify the photographer.

Children must be supervised at all times in the studio.
